Welcome to PublicExchangeCenter ("we," "our," or "us"). These Terms & Conditions ("Terms") dictate the usage of our yacht charter services and the website located at publicexchangecenter.sbs (the "Service") managed by PublicExchangeCenter.
By renting a yacht or using our Service, you consent to adhere to these Terms. If you do not agree with any part of the terms, then you are not permitted to access the Service.
2. Service Overview
PublicExchangeCenter offers elite yacht charter experiences, which include but are not limited to:
- Day-long yacht rentals
- Evening cruises
- Business retreats
- Exclusive gatherings
- Extended charters
Our services are contingent upon availability and climatic conditions. We hold the right to alter or withdraw services without prior notice.
3. Booking and Reservations
3.1 Booking Process
To reserve a charter, you are required to:
- Have reached the age of majority, which is 18 years old
- Provide truthful and complete details
- Make the necessary deposit payment as indicated in your reservation confirmation
- Accept these Terms & Conditions
3.2 Confirmation
A confirmed reservation is established upon the successful processing of your payment and our issuance of a confirmation. We reserve the full right to decline service to anyone at our own discretion.
3.3 Availability
Charter availability is dependent on the accessibility of vessels and favorable weather. Reasonable efforts will be made to accommodate your requested dates and times.
4. Payment Terms
4.1 Pricing
All charges are provided in € and are inclusive of taxes unless specified otherwise. Prices are subject to modifications without any prior notification.
4.2 Payment Schedule
- Deposit: You're required to pay 50% of the full charter cost at the time of booking
- Full Payment: Should be completed 48 hours before the charter departure
- Additional expenses (if applicable): Are to be paid after the charter concludes
4.3 Payment Methods
We accept primary credit cards, wire transfers, and certified cheques. Payment processing is conducted through secure, encrypted channels.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- More than 72 hours prior to departure: Full refund minus administrative charges
- Between 24 and 72 hours before departure: 50% refund
- Less than 24 hours prior to departure: No refund is possible
5.2 Weather Cancellations
If our captain deems weather conditions as unsafe, we will propose to:
- Move your charter to a subsequent available slot at no extra charge
- Issue a full refund if rescheduling is unfeasible
5.3 Mechanical Issues
If there's a mechanical issue with the assigned vessel, we will aim to supply an appropriate alternative. Should no such alternative be available, a complete refund will be granted.
6. Safety and Conduct
6.1 Safety Requirements
Passengers must:
- Abide by all instructions given by the crew
- Wear necessary safety gear when instructed
- Inform us of any health conditions that could influence their safety
- Stay within the allowed areas on the yacht
6.2 Prohibited Items
The following are prohibited onboard:
- Containers made of glass
- Illegal substances
- Weapons of any kind
- Excessive quantities of beverages (beyond what might be consumed reasonably)
- Pets (save for those granted approval beforehand)
6.3 Conduct
Guests are expected to behave respectfully. A charter may be terminated prematurely without a refund if a guest's conduct endangers safety or mars the experience of others.
7. Liability and Insurance
7.1 Our Liability
We limit our accountability to the cost you've paid for your charter. We are not liable for:
- Injuries sustained due to your own negligence
- Theft of, or damage to, personal belongings
- Secondary, incidental, or punitive losses
- Delays prompted by inclement weather or factors beyond our regulation
7.2 Insurance Coverage
Appropriate marine insurance is maintained for our vessels and operations. It is your responsibility to ensure suitable travel and personal insurance coverage.
7.3 Assumption of Risk
By engaging in our charter services, you recognize the inherent perils of maritime activities and agree to be responsible for your personal safety and security.
8. Modifications and Itinerary Changes
We reserve the authority to change itineraries, paths, or timetables due to weather, safety considerations, or operational necessities. Efforts will be made to offer comparable alternatives.
9. Force Majeure
Our company is not responsible for delays, cancellations, or alterations spawned by events outside of our control, which include but are not limited to:
- Extreme weather
- Natural catastrophes
- Governing laws or restrictions
- Port shutdowns
- Technical breakdowns
10. Privacy and Data Protection
Your personal data is treated according to our Privacy Policy. By using our facilities, you agree to the collection and usage of your data as outlined in our Privacy Policy.
11. Intellectual Property
The material on our website, including text, graphics, icons, and imagery, is secured by copyright and trademark directives. Unauthorized reproduction, distribution, or the creation of derivative works is prohibited without our explicit consent.
12. Governing Law
